Thai Man Stuck with His German Husband

BERLIN (Reuters) - A Thai man who masqueraded as a woman to wed a German man has failed to get the marriage annulled, and now seems saddled with his husband.
A German court dismissed the Thai's request for an annulment because same-sex marriages are not recognized in Germany, and therefore cannot be reversed.
"I don't know why they got married, whether it was love or the desire for a residence permit," said Ulrich Skwirblies, a spokesman for the court in the western town of Celle.
The 42-year-old Thai married the man in Denmark under a false name in 1994 and was later granted German residency.

Okay, I am confused now. If same-sex marriages are not recognised in Germany, then the Thai man wouldn't need an annulment.
Although this also means that his residence permit is invalid. Ooops.

well he dressed up as a woman to marry the german man, because same sex marriages aren't recognized.
what i want to know is, how did the german man find out he wasn't a woman?!

No, what I want to know is if they got married in 1994, why did it take this long to figure out he wasn't a woman?!

Oh I am quite sure that his German husband knew what the situation was.
No, what I am confused about is why he went for the annulment. The Thai man has his residency status, and since same-sex marriages are not recognised in Germany he had no need for an annulment, and therefore NOT stuck with his husband (no matter what the headline says).
Was he trying to make a point?

I'm with you Nicola, it doesn't make sense. You were never married under German law, so you cannot have annulment, so you must stay married under German law.
Can I bring Hogan's Heros Col Klink to mind?

I'm with you Third EYe, but I'm a bit confused. If same-sex marriages are not recognized in Germany then how could their marriage certificate be recognized. I mean if the Thai guy plans on travelling to another country then yes he would have to get this mess sorted out, but of course that's gonna complicate things even further. So, what I mean is if he stays in Germany he's not really married at all. Or, have I missed something.

The more we mull over this article the more I think the Thai man was trying to make a political point. But I missed something the first time I read the article.

He was married in Denmark. I don't know what the same-sex marriage situation is in Denmark, but that would certainly add confusion to the mix.

October 1, 1989 – Denmark
Denmark becomes the first country to legally recognize same-sex partnerships, essentially sanctioning gay marriages. The Danish Registered Partnership Act states "Two persons of the same sex may have their partnership registered" and "the registration of a partnership shall have the same legal effects as the contracting of marriage."
By 2001, Norway, Sweden, Iceland, the Netherlands and France recognize registered partnerships and Italy, Spain and Israel are considering adopting similar legislation.
This article does not state whether this is a registered partnership or a marriage, so it is still confusing.
However, I still think the Thai man is trying to make a political point. 'Cause he is going to lose his residency permit over this.

I found this article under "Reuters oddly enough". I must say I was confused and still am. I thought that someone on this board smarter than I could figure it out.
