Diana Ross Convicted of DUI

TUCSON, Ariz. - Diana Ross was convicted Monday of driving under the influence and ordered to spend two days in jail.

The R&B diva, who telephoned into the city court hearing from New York, pleaded no contest to DUI. Two related charges were dropped.

Tucson Magistrate T. Jay Cranshaw found Ross guilty of DUI and sentenced her to serve 48 hours in jail before March 9. She also was sentenced to a year of unsupervised probation.

Ross, 59, originally was charged with driving under the influence, driving with a blood alcohol concentration of 0.08 percent or more and extreme DUI with a blood alcohol concentration of 0.15 percent or more.

Tucson police arrested her Dec. 30, 2002, after a driver called to report a car traveling southbound in the northbound lanes just outside the city's northeast limits.

Breath test results showed Ross had a blood alcohol concentration of 0.20 percent. Arizona's legal limit is 0.08.

How could she telephone in to her court hearing? She should get two days in jail just for not having the decencey to even show up to her own hearing!

On a side note- in my toxicology class we've been discussing how the breathalizer thingies aren't really all that accurate and can be wrong alot of the time. My prof stressed the need for other proof- like driving south in a northbound lane.

I wonder if she'll phone her jail time in too?

i think her hair needs to develop a conscience and stop her drinking problem. cause it obviously has a life of it's own, so i think it needs to be aware of what it's duty is...

One wonders if all the people she stepped on getting to the top ( i.e. Mary Wilson & the late beloved Florence Ballard ) are finally coming back to haunt her.

Her career has been in a constant nose dive the last few years!

She's "another" Martha Stewart" type!

I remember this in the news a while back – this guy was a pyro performer. He had an act of spitting fire. Anyway – he was on his way home from a performance when a cop pulls him over. The cop smelled the alcohol-based solution he uses for his act and gave the guy a Breathalyzer test. He failed miserably and was arrested – despite the guy pleading with him about his act.

So the guy goes to court and, on the stand, testified what went down. He explained that he was a pyro performer and wanted to prove his innocents.

The Judge ordered he be given a Breathalyzer test. He passed. Then the guy, the jury, the Judge and everyone in the courtroom, went out into the parking lot so the guy could perform his act. After about 15 minutes they reconvene in the courtroom and guy is given another Breathalyzer test. His BAC, according to the machine, was so high that the Breathalyzer overloaded and broke.

This is honest to the Goddess a true story!!!

I believe you! It's not completely trustworthy for sure. The blood level is the best way to go.

Can one request a blood ETOH level if they believe the breathalizer is erroneous?

Years ago when I first started in the clinical lab field - when other people's blood wasn't much considered a hazard - when we got an ETOH level we'd open the tube and smell it and pass it around. Then we'd all place bets on what the level was going to be! You can actually smell the ETOH in the blood! So of course the stronger the smell the higher the level!

Kind of twisted, but we had to create some kind of fun at work!

Of course in this day and age no one would be caught dead smelling blood.:whip:
