Texas man arrested after rescuing swimmer
Authorities allege David Newman interfered with emergency personnel

Updated: 9:33 a.m. ET July 5, 2005
SAN MARCOS, Texas - A man who rescued a swimmer caught in swirling river currents found himself in trouble soon afterward when he was arrested by authorities who claimed he was interfering.

Dave Newman, 48, disobeyed repeated orders by emergency personnel to leave the water, police said. He was charged with interfering with public duties.

“I was amazed,” Newman said Monday after his release on $2,000 bail. “I had a very uncomfortable night after saving that guy’s life. He thanked me for it in front of the police, and then they took me to jail.”

Abed Duamni, 35, of Houston, said he had just finished eating at a restaurant Sunday when he decided to go for a swim in a nearby river. Duamni said he didn’t see any signs warning swimmers of dangerous currents.

Newman said he pulled Duamni out of the water, swimming under a waterfall and over to the shore opposite from the restaurant. He could hear law enforcement personnel telling him to come back to the other side.

According to police, Newman smirked and seemed annoyed by officers’ requests. He stood in the water for about 15 seconds before swimming downstream.

“When he came across the river, the officer stuck out his hand like he’s going to help him out of the water, and he put cuffs on him,” said John Parnell, pastor of St. Augustine Old Roman Catholic Church in Fort Worth.

okay. i know that this is going to be one of those irate "how dare they do that?" stories but the man was interfering. quite possibly he could've gotten caught up too and the authorities would have had to deal with two people to rescue.

I'm not quite sure how I feel about this. It's probably not a good idea to let private citizens ignore warnings from rescue personnel, and the rescuers might have ended up with two people to save because he refused to listen to them. Then again he did save the guy's life. The cops should have let him off with a warning.

He jumped in like five minutes before the cops even showed up. If it hadn't been for him, the guy would have drowned.

Yeah, without more information it's hard to tell. For all we know, what he did could have been very reckless, and it was only luck that he managed to rescue the other man. If the cops were on the scene, and dealing with the situation, and then this man decided to jump in and play hero...he may very well have screwed up.

Dunno though. It's hard to tell.

it is hard to tell but the tone of the story was very biased.

In fact he most definately would have drowned. My university is across the street from where this happened. About 3-4 people die every year in that spot, for not having any common sense. In fact police had to fish out a body that got stuck in the undertow there two months ago.

And there are warning signs, a pretty big one. It's illegal to swim or wade in that area. But morons do it anyway. It's bad enough that they want to go swimming with the leeches, and ringworm, but then they decide it will be fun to go dive under the churning waters of a man-made water fall.

Here's a picture of it. This is what it looks like on a good day.

You can't see it, but off to the left on the bank is a large warning sign.

Oh, and the small blurry sign at the top.

then the guy who jumped in to take a swim was asking for a darwin award.

Damn straight. He's just lucky that there are some who would risk their neck to save stupid people.

See, but this quote makes it seem like both the officers and the man who jumped in to save the guy were on the scene at the same time.

First rule of rescue.....safety
Second rule of rescue...don't become a victim
Third rule of rescue...the guys an idiot, if he had gotten into trouble then he would mean more work for the rescuers, potentially putting more peoples lives at risk.

Though arresting may seem over the top, it depends on what his atttiude and other stuff..

Has anyone else heard of the rule that you have to wait an hour after eating before you go swimmimg? (All your blood goes to your stomach to digest your food instead of your arms and legs)
